Form 1042
This is the Annual Withholding Tax Return for U.S. Source Income that accounts for all payments made to nonresident property owners and the tax withheld on those payments.
Form 1042-S
A Form 1042-S is issued to every non-U.S. property owner in order to report their rental income and any tax withheld. If you manage properties for international clients, you must prepare a separate Form 1042-S for each owner and provide copies to both the IRS and the client.
This is a series of documents used to collect beneficial owner documentation, establishing foreign status and determine the correct tax withholding on their income.
This is a document that is used by U.S. persons to provide their taxpayer identification number (TIN) and certify that they are a U.S. Person and not subject to backup withholding.
Form 1099-MISC
This form is used to report rental income that has been paid to U.S. property owners. If you manage properties for U.S.-based clients and collect rent on their behalf, you will typically issue Form 1099-MISC to report the gross rents paid during the year.

If you support nonresident investors in managing their U.S. property, the IRS will generally consider you to be a withholding agent. This means that you have a responsibility to withhold tax and remit it to the tax office on their behalf.
Withholding agents should typically withhold 30% of the rental income paid to a foreign person for tax purposes. However, this statutory withholding rate may be reduced if the owner files form W-8ECI.
You will typically need to collect Form W-8BEN (for individuals) or W-8BEN-E (for entities) to confirm foreign status and determine the correct withholding treatment.
Meanwhile, a Form 1042 tax return must be filed in order to disclose all rental income earned.
